Definitions
Website: Refers to the website owner/operator INDUSTRACOM Pty Ltd (www.industracom.com, Australia ABN 20 079 858 236) operators of IndustrySearch.com.au and MedicalSearch.com.au.


Storefront Advertising Terms & Conditions

These are the standard Terms & Conditions for the website's Storefront advertising packages. By entering into an agreement with the website or an authorised representative, advertisers are legally bound to the advertising terms and conditions. Advertisers agree to adhere to the parameters of the advertising package they purchase. The website maintains the right to alter features of advertising packages. The website maintains the right to deny any company from advertising.

Definitions
Website: refers to the website owner/operator. Industracom P/L - www.industracom.com.
Advertiser: refers the business purchasing advertising on the website.
Packages: refers to the annual Storefront marketing and advertising service.

Terms of Use
The website provides online advertising and marketing services which comply with the following terms of use:
- Advertisers must be locally or internationally registered;
- Products and services on offer must be lawfully acquired;
- Products and services on offer must be of a legal nature;
- Advertisers must not make untrue, or unsubstantiated claims about their products and services;
- Advertisers must be committed to providing adequate service and support to their customers;
- Advertisers must comply with commercial law in the regions in which business is conducted;
- Advertisers must clearly define its purpose, products, and/or services;
- Advertiser's promotional information must adhere to international Copyright and Trademark law;
- Advertisers must have authorisation to promote and market listed items;
- If the advertiser is exclusive to a specific geographic region, they should make it clearly evident;
- Advertisers of adult or gambling products and services are not accepted.

Billing & Payment
All Storefront packages are a minimum 12 month contract. By entering into a signed agreement for the advertising packages, advertisers enter are legally bound and are obligated to adhere to the terms and conditions of the website. The website maintains a comprehensive credit collection process. Overdue accounts (60 days+) are referred to a credit collection agency. This could effect an advertiser's credit rating therefore every effort is made to collect outstanding payments before such action is taken.

1. Monthly Payment Option - The first monthly payment must be received before setup commences. Payments will continue and Storefronts will remain active until cancelled. Storefronts can be cancelled anytime after the first 12 month period.

2. Yearly Payment Option - 30 days prior to expiry, a renewal offer will be sent. The Storefront will be renewed only once the approved renewal offer is received back from the company. Following 30 days after the expiry date, Storefronts will be reset. Advertisers should renew before the expiry date in order to maintain their preferential search ranking, as well as their information on the website.

Trial Accounts: Trials are not provided unless otherwise agreed in writing as part of special promotional offers.

Directory Categorisation
The website's directory is under constant development and improvement in consultation with vertical experts and advertising customers. Advertisers are assigned to a designated number of categories depending on the package purchased. Advertisers can suggest new categories for inclusion in the directory. Our editors reserve the right to include or deny category suggestions. If a new category is added, relevant existing advertisers will be included. Advertisers are categorised at the discretion of our editors who reserve the right to add, remove or rename categories.

Category Ranking
Categories are those listed within the main Directories. Within categories, advertisers on higher packages are listed above lower packages, followed by date order, with longer active advertisers listed first.

Directory Showcasing
Advertiser logos are showcased in the Directory most relevant to them. Additional Directory logo placements can be purchased. The size and position of logos is based on the Storefront package. When a new Storefront is activated or an existing one renews; their logo is placed in the top position in the relevant Directory, with existing Storefronts moving down respectively.

Content Items
Depending on the package, Storefronts have the capacity to feature a designated number of content items including: products & services, news, feature articles, events & videos. File, text and images sizes must comply with required system specifications.

Activation
Step 1
- Profile Setup: Once an Activation Form is received by fax, advertisers are sent an e-mail outlining the requirements to setup their Storefront's profile. This includes such items as a company description, contact details and logo. Advertisers can request for one of our consultants to setup their profile on their behalf, using information from their website or other marketing material.

Step 2 - Upload Content: Once Step 1 is completed, Storefront owners are ready to upload their content (products, news releases, feature articles and events), which is the most important aspect of the Storefront in generating results. Storefront owners are provided with a username and password to gain access to their Storefront Management Area to upload content. Storefront owners should have all their Products uploaded as a first priority. Following that News releases, Feature articles and Events are also important in generating results.

- The Storefront User Guide helps advertisers understand how best to utilise their Storefront.
- Storefront Advertisers can receive support and assistance from our team at anytime.

Hot Products
Hot Products are an additional advertising service over and above Storefronts. Advertisers must be a current Storefront owner to purchase Hot Products.

System Maintenance
The website takes reasonable steps to ensure the service is properly maintained and kept up-to-date, to protect against the loss, misuse and/or alteration of customer information.

Backing-up of Data
The website backs up customer data and information onto backup equipment on a regular basis, however the website will not be liable for loss of data.

System Rights
Advertisers obtain no rights to the hardware, software and other infrastructure and facilities provided or used by the website to deliver the service, other than expressly defined as part of the Storefront use for that customer.

Liabilities and Warranties
The website or any of its subsidiaries, management, employees, partners or suppliers will not be liable for: - 
(i) any indirect or incidental damages of any kind; 
(ii) any damages including those resulting from:

(a) loss of use, data/information, revenue or profits, on any case amounting out of or in connection to the use (or inability of use) of the Service; 
(b) the statements of any employee of the website; 
(c) any unauthorised access to or modification of the customers website or Storefront; 
(d) any data or information that is sent or received or not sent or received; 
(e) any failure to store data, information files or other related content to the Service; 
(f) fraudulent, negligent or otherwise unlawful behaviour; 
(g) information, data or other material provided to the website.

Privacy Policy
The customer will agree to abide by the website's Privacy & Information Policies which compliments these Standard Terms & Conditions, and agree that the terms of these two policies are included in this policy in agreement between the customer and the website.

Rights and Responsibilities
The customer is responsible for dealing with persons who access the customer data and information and will not attempt to refer complaints, feedback or comments in relation to this data and information to the website. The customer will cover the website against all possible costs, expenses, loss or liability that we may directly or indirectly suffer resulting from:

(a) the customer breaching these terms set out;
(b) the customer, or any person using the website's customer account or misusing the service;
(c) the publication of offensive or unlawful material on any part of the website in using the service.

Suspension and Termination
We reserve the right on occasion and without prior notice to suspend the service and/or disconnect or deny access to the service either during technical failure or maintenance procedures or if customers fail to comply with terms and conditions or do anything which in the website's frame of view or opinion may effect or undermine the operation of the website.

General
These Standard Terms & Conditions are governed by the laws of New South Wales, Australia. The website's failure to exercise or to enforce any right or provision of the Agreement will not constitute a waiver of such right or provision.

Unsolicited & Lawful Offers
Requests placed with the website advertisers must be of a legal and lawful nature and must be in relation to the nature of business conducted by the advertiser. We strongly encourage individuals not to utilise the website's communication facilities to solicit businesses in relation to items which have not been requested (i.e. unsolicited offers).

Cancellation Policy
Due to a quota of one Email Campaign per week (5 days) and limited Banner inventory, cancellations within 60 days of campaign dates are not refundable and outstanding invoices will remain due for payment. Clients may however reschedule campaigns to alternative dates at no additional fee.

Email Campaigns
Due to the website's limited inventory of one Email Campaign per week (5 days), cancellations within 60 days of campaign dates are not refundable. Clients may however reschedule campaigns to alternative dates at no additional fee.

Banner Advertising
Due to the website's limited inventory of Banner Advertising space, cancellations within 30 days of campaign dates are not refundable. Clients may however reschedule campaigns to alternative dates at no additional fee.
